The MAF temple near the Tithe Church should be dismantled

This was announced today by the Minister of Culture Oleksandr Tkachenko on Facebook.

"The MAF temple near the Tithe Church must be dismantled - this is our unequivocal position. The building of the chapel, the so-called Church of the Tithe Church of the Most Holy Theotokos, which is illegally located on the territory of the National Museum of the History of Ukraine, is a spontaneous construction and was built by the Religious Community of the Ukrainian Orthodox Church of the Moscow Patriarchate." , - said the minister.

We will remind that back in 2008, in the historical center of the city on the territory of the National Museum of the History of Ukraine at 2 Volodymyrska Street, a "temporary" church tent suddenly appeared for the Easter service, which over time was transformed into a wooden chapel, and later into a full-fledged temple. It was arbitrarily erected by priests from the UPC MP near the historical foundation of the ancient Tithe Church for the further construction of a new church, which the representatives of the church called "the revival of the unique symbol of Orthodoxy - the Tithe Cathedral." During Yanukovych's time, the church community received ownership of the building itself, but the representatives of the church do not have any construction permits, even near the foundation of the ancient Tithe Church. The building itself, says Tkachenko, was built without an approved project, without obtaining construction permits, and it was not put into operation in the prescribed manner.

Since 2020, a trial has been ongoing on a lawsuit filed by the National Museum of the History of Ukraine regarding the removal of obstacles to the use of the land by demolishing the self-contained object.

The Ministry of Culture and Information Policy of Ukraine is involved in the case as a third party and contributes to this process.

"The examination has already been completed, and the next court session is scheduled for January 18, 2023. "Therefore, there is a well-founded hope that soon the dispute will be resolved in a legal way," the minister said.

In addition, a few days ago, Vasyl Nikolyshyn, a native of Kyiv, registered petition No. 11648 on the KMDA website with a request to demolish the illegal "MAF temple" of the Moscow Patriarchate, located in the historical center of Kyiv. As of today, she has already collected more than half of the required 6,000 votes.

In the description of the petition, the Kyivan notes that the location of the church-chapel violates the following norms:
- located in the buffer zone of UNESCO monuments, where new construction is prohibited,
- disturbs the ensemble of the historical archaeological complex "Tithe Church",
- the capital building does not have a postal address, and therefore cannot be used by citizens, because it is essentially a construction site.

"In addition to the above, the facility located in the building spreads anti-Ukrainian narratives and has been working for the aggressor country for more than 14 years in a row," Mr. Vasyl is indignant.

"Храм-МАФ біля Десятинної церкви має бути  демонтовано - це наша однозначна позиція. Будівля каплиці, так звана церква Десятинного Храму Пресвятої Богородиці, яка незаконно розташована на території Національного музею історії України, є самочинним будівництвом та споруджена Релігійною громадою Української православної церкви московського патріархату", - зазначив міністр.

Нагадаємо, що ще в 2008 році в історичному центрі міста на території Національного музею історії України на вулиці Володимирській, 2, раптово з’явилася "тимчасовий" церковний намет для звершення великоднього богослужіння, що з часом трансформувався у дерев’яну каплицю, а згодом і у повноцінний храм. Його довільно звели священники з УПЦ МП неподалік історичного фундаменту старовинної Десятинної церкви для подальшого зведення нового храму, що представники церкви називали "возрождєнієм унікального символа Православія - Десятінного собора". За часів Януковича церковна громада отримала право власності на саму будівлю, однак жодних дозволів на будівництво, ще й поблизу фундаменту стародавньої Десятинної церкви представники церкви не мають. Сама будівля, каже Ткаченко, споруджена без затвердженого проєкту, без отримання дозволів на будівництво, в експлуатацію її у встановленому порядку не введено.

З 2020 року триває суд за позовом від Національного музею історії України щодо усунення перешкод у користуванні земельною ділянкою шляхом знесення самочинного об’єкта.

Міністерство культури та інформаційної політики України залучене до справи як третя сторона та сприяє цьому процесу.

"Експертиза вже завершена, а наступне судове засідання призначене на 18 січня 2023 року. "Отже є обґрунтоване сподівання, що невдовзі спір таки буде вирішено в законний спосіб", - сказав міністр.

Крім того, кілька днів тому киянин Василь Николишин зареєстрував на сайті КМДА петицію №11 648 із проханням знести незаконний "храм-МАФ" московського патріархату, що знаходиться в історичному центрі Києва. На сьогодні вона вже набрала понад половину з необхідних 6000 голосів.

В описі до петиції киянин зазначає, що розташування церкви-каплиці порушує наступні норми:
- знаходиться в буферній зоні пам’яток ЮНЕСКО, де заборонене нове будівництво,
- порушує ансамбль історичного археологічного комплексу "Десятинна церква",
- капітальна споруда не має поштової адреси, а тому не може використовуватись громадянами, адже по суті є будівельним майданчиком.

"Окрім вищезгаданого, заклад, що знаходиться в споруді, поширює антиукраїнські наративи та працює на країну-агресора понад 14 років поспіль", — обурюється пан Василь.
