The court returned the Tereshchenko palace in Zhytomyr region to the state

The Commercial Court of the Zhytomyr Region decided to return the Tereshchenkos' estate in Chervone, which was owned by the Zhytomyr Diocese of the UOC (MP), to the state. This is reported by "Ukrinform".

At the meeting on August 30, the court satisfied all the demands of the Berdychiv district prosecutor's office. In its lawsuit, the department asked, in particular, to invalidate the agreement concluded in 2000 between OJSC "Chervonensky Sugarmaker" and the Zhytomyr diocesan administration of the Ukrainian Orthodox Church on the free transfer of Tereshchenko's estate; cancel the certificate dated 02.10.2012 on the right of private ownership of the buildings of the Holy Christmas of Christ Chervonen Monastery; claim immovable property from the ownership of the monastery for the benefit of the state, represented by the Ministry of Education and Science (a non-residential building of the monastery with an area of 2802.7 sq. m and two farm buildings with an area of 1264.7 and 394.5 sq. m).

The representative of the defendant, Maryna Sholodko, called the court's decision illegal and said that it will be appealed.

Earlier, the Supreme Court supported the position of the Zhytomyr Regional Prosecutor's Office regarding the illegality of the transfer of the Tereshchenko palace in Chervone to the property of the Zhytomyr diocese of the UOC (MP) and decided to refer the case to the court of first instance for further consideration and adoption of a legal decision to protect state interests.

The Tereshchenko Palace was built in 1861 by Adolf Groholsky, after his death it became the property of the famous philanthropist and sugar industrialist Mykola Tereshchenko. After the arrival of the Bolsheviks, an orphanage was set up there, and later - a factory school.

The object is an architectural monument of local importance.

In 2000, OJSC "Chervonensky Sugarmaker" transferred the estate to the Zhytomyr Diocese free of charge. In 2001, in part of the palace, the Chervonensky Monastery of the Holy Christmas of Christ was created, subordinate to the Zhytomyr Eparchy of the UOC (MP). The diocese did not have a protection agreement for the architectural monument.

The Berdychiv district prosecutor's office established the fact of the illegal disposal of state-owned property - the Tereshchenko estate and appealed to the court with a claim for the return of the lost real estate to the state. All court decisions on refusal were appealed by the prosecutor's office.

Господарський суд Житомирської області ухвалив рішення повернути державі маєток Терещенків у смт Червоне, який перебував у власності Житомирської єпархії УПЦ (МП). Про це повідомляє "Укрінформ".

Суд на засіданні 30 серпня задовольнив усі вимоги Бердичівської окружної прокуратури. Відомство у своєму позові просило, зокрема, визнати недійсною укладену 2000 року угоду між ВАТ "Червоненський цукровик" та Житомирським єпархіальним управлінням УПЦ про безкоштовну передачу маєтку Терещенка; скасувати свідоцтво від 02.10.2012 про право приватної власності на будівлі Свято-Різдва Христового Червоненського монастиря; витребувати з володіння монастиря на користь держави в особі Міністерства освіти та науки нерухоме майно (нежитлову будівлю монастиря площею 2802,7 кв. м та дві господарські будівлі площею 1264,7 і 394,5 кв. м).

Представник відповідача Марина Шолодько назвала рішення суду незаконним і заявила, що воно буде оскаржене.

Раніше Верховний суд підтримав позицію Житомирської обласної прокуратури щодо незаконності передачі палацу Терещенків у смт Червоне у власність Житомирської єпархії УПЦ (МП) і ухвалив направити справу до суду першої інстанції для продовження розгляду та прийняття законного рішення на захист державних інтересів.

Палац Терещенків побудований у 1861 році Адольфом Грохольським, після його смерті перейшов у власність відомого мецената та цукрового промисловця Миколи Терещенка. Після приходу більшовиків там облаштували сирітський притулок, а згодом – фабрично-заводське училище.

Об’єкт є пам’яткою архітектури місцевого значення.

У 2000 році ВАТ "Червоненський цукровик" безкоштовно передав маєток у власність Житомирської єпархії. У 2001 році в частині палацу створили Червоненський Свято-Різдва Христового жіночий монастир, підпорядкований Житомирській єпархії УПЦ (МП). Охоронного договору на пам’ятку архітектури єпархія не мала.

Бердичівська окружна прокуратура встановила факт протиправного вибуття майна державної форми власності – садиби Терещенка і звернулася до суду з позовом про повернення втраченої нерухомості державі. Усі судові рішення про відмову прокуратура оскаржила.
